Terms and conditions

1. Acceptance and parties

These Terms govern access to, contracting for and use of ComeDisdire. By purchasing or using the services, the user confirms that they have read and accepted these Terms, the Privacy Policy, the Cookie Policy and the Cancellation and Refund Policy. The contract is made between the user and Zemobile LLC, as Platform operator, contractual service provider and entity responsible for collecting payment. Elite Media Applications, S.L. carries out marketing and advertising activities and neither provides nor charges for the services.

2. Capacity to contract

The user confirms that they are at least eighteen years old, have sufficient legal capacity, are the holder of the contract they wish to cancel or have proper authorisation, will provide complete and accurate information and are authorised to use the payment method supplied. ComeDisdire may request additional checks where there are reasonable doubts concerning identity, authority, security or the legitimacy of the transaction.

3. Services purchased

The initial cancellation service may include collecting information, preparing a request, processing and transmitting the communication, generating or retaining technical evidence and providing access to available status information and supporting records.

After purchasing the initial service, ComeDisdire may offer the user the option to purchase Meno Club. This subscription is separate and is activated only where the user provides express, separate acceptance.

Meno Club includes an initial seven-day free period. Once this period ends, the subscription renews automatically at €39.95 per month, including taxes, until cancelled. The initial period, price, frequency and other subscription terms will be those shown in the offer accepted by the user.

4. Start and performance of the initial service

The initial service begins when the user confirms the purchase and ComeDisdire starts processing it. Processing may include checking information, preparing the request, generating documents, transmitting the communication and creating or making technical evidence available.

The service is fully performed once ComeDisdire has completed the essential operations for the purchased service, including preparing and transmitting the request or making the relevant result or supporting record available to the user. A recipient company's failure to read, answer, accept or act on the request does not, by itself, affect whether the service is considered started or fully performed.

5. Information provided by the user

The user is responsible for the accuracy of their identity and contact details, customer or contract number, the company and service they wish to cancel, recipient details, requested date or method and any documents supplied. Missing or incorrect information may delay or prevent performance and will not be attributable to Zemobile LLC.

6. Communications, evidence and outcome

ComeDisdire may generate technical records concerning the content, processing, transmission, technical delivery or availability of a communication. Such evidence records the technical events shown in it. Its legal effect depends on applicable law, the circumstances and the assessment of the recipient, competent authority or court. ComeDisdire is not a public administration, notary, public authority or universal postal operator.

ComeDisdire does not control the recipient's decisions and does not guarantee acceptance of the request, effective cancellation, the cancellation date, the absence of minimum terms or penalties, repayment of any amount, the automatic cessation of future charges or that the recipient will not request further information.

7. Prices and payments

Applicable prices are displayed during the relevant purchase process. Payment for the initial service and purchase of Meno Club are separate authorisations. Where the user expressly accepts Meno Club, they authorise Zemobile LLC to collect the applicable recurring charges and taxes after the free period. Payments are processed securely through Stripe.

8. Meno Club

Meno Club may include subscription dashboards, budgeting tools, expense tracking, alerts, reminders, information about potential savings and access to benefits or discounts. Spending and savings figures are informational estimates; they are not financial advice and do not guarantee actual savings. ComeDisdire may modify, replace or withdraw features within the limits of applicable law.

9. Renewal and cancellation of Meno Club

When the user purchases or activates Meno Club, the subscription includes an initial seven-day free period. Once that period ends, it renews automatically for monthly periods and €39.95 per month, including taxes, will be charged until cancellation. The user must keep a valid payment method while the subscription remains active.

The user may request cancellation through the options provided on the Platform or by emailing support@comedisdire.com. Cancellation prevents renewals after it takes effect but does not automatically entitle the user to a refund for periods already billed, unless applicable law provides otherwise. Cancelling Meno Club does not affect an initial service whose processing has already started. A refund of a particular charge does not automatically cancel the subscription.

10. Right of withdrawal

Where European distance-contracting rules apply, consumers generally have fourteen calendar days from the date of the contract to exercise their right of withdrawal.

By asking for the initial service to begin immediately, the user expressly requests that ComeDisdire start performance before that period ends. If the user validly withdraws after the service has started but before it has been fully performed, Zemobile LLC may deduct or require payment of the proportionate amount for the part already provided.

The right of withdrawal is lost once the service has been fully performed, provided performance began with the user's express consent and their prior acknowledgement that the right would be lost on completion. These provisions apply without prejudice to mandatory consumer-protection rules.

11. Subsequent obligations

After transmission, the user is responsible for consulting available status information, responding to recipient requests, checking whether cancellation has taken effect, reviewing charges and invoices and contacting the recipient directly where necessary. Sending a request is not final confirmation of cancellation.

12. Prohibited uses, suspension and termination

Users must not impersonate another person, request cancellations without authority, enter false data, threaten or harm third parties, send unlawful communications, commit fraud, infringe rights or interfere with security. Zemobile LLC may suspend or cancel an account or service in the event of breach, fraud, abuse, impersonation, security risk, non-payment or an authority's requirement. Termination does not extinguish obligations already accrued.

13. No professional advice

ComeDisdire's information and tools are general and technological in nature. They do not constitute legal, financial or tax advice. Users should obtain independent advice on matters involving debt, minimum terms, litigation or significant consequences.

14. Availability and liability

Services may be affected by maintenance, updates, network failures, infrastructure incidents, external providers, cyber incidents or force majeure. ComeDisdire does not guarantee uninterrupted or entirely error-free availability.

To the fullest extent permitted by law, Zemobile LLC will not be liable for a recipient's refusal or delay, charges under the original contract, user errors, changes to third-party procedures, external failures outside its reasonable control, indirect loss, loss of profit, loss of opportunity or use of the evidence. Total liability is limited to the amount paid during the three months preceding the event giving rise to the claim. This limitation does not affect liability that cannot be limited or non-waivable rights.

15. Retention of evidence

ComeDisdire may retain evidence for the period applicable to the purchased service or plan. Retention does not imply uninterrupted availability or permanent preservation. Once the relevant period ends, ComeDisdire may delete, anonymise or archive evidence, or block access to it, in accordance with applicable rules. Users are responsible for downloading and keeping any copies they consider necessary.

16. Changes

Zemobile LLC may change these Terms and service features to reflect legal, technical, commercial or operational developments. The version applicable to a purchase is the version accepted by the user, subject to mandatory rules.

17. Governing law, jurisdiction and language

These Terms are governed by the laws of the State of Delaware, United States, without prejudice to mandatory protection afforded to consumers in their country of residence. Consumers may bring proceedings before the courts of their domicile where permitted by applicable law. Business users submit to the competent courts of the State of Delaware, unless a mandatory rule provides otherwise.

The Terms may be available in several languages. The version made available to and accepted by the user during purchase applies, without prejudice to rights granted by mandatory rules. If a provision is declared invalid, the remaining provisions continue in effect.
